Terms and Conditions for Purchases from Living Springs Farm

By making a purchase through LivingSpringsFarmTN.com, you (the “Buyer”) acknowledge and agree to the following terms and conditions. These terms govern all purchases of farm products, including but not limited to beef, pork, and chicken. By completing a transaction on our website, you agree to abide by these terms.

Deposit and Payment

Deposit Requirement – A deposit is required within 14 days of purchase to reserve your share. This deposit will be deducted from the final purchase price. All deposits are non-refundable unless Living Springs Farm fails to deliver the product as agreed or secures a suitable replacement buyer.

Final Payment – The final balance for your order will be will be based on hanging weight for beef and pork, and by the totaly quantity for whole chickens. For beef and chicken payment is due within 5 days after the buyer is notified of the final balance, and for pork payment is due within 2 days after the buyer is notified of the final balance. Any unpaid balance after the due date may result in the loss of deposit and forfeiture of the ability to purchase from us in the future.

Processing Fees – Processing fees are not included in the product price unless otherwise specified in the product description. Buyers are responsible for paying all processing fees directly to the processor.

Husbandry. The animal will be:

  • The animal is raised and finished 100% grass fed and on open pasture (unless otherwise specified)
  • Finished on Certified Organic feeds and on pasture (*All Organic Grain and Grass Finished Beef)
  • Raised on Non GMO feeds and on pasture (*All Pastured Chicken and Pastured Pork)
  • Raised without use of antibiotics
  • Raised without the use of hormones, steroids, and vaccines
  • Raised on pasture without the use of Glyphosate, Herbicide, and Chemical Fertilizers
  • Emergency Care/change of management- In the event that an animal requires treatment methods that vary from the above, the seller will notify the buyer immediately of the change in management. The seller will have the option to continue or to cancel the contract. If the seller would like to cancel the contract, a full refund of the deposit will be issued.

Pickup or Delivery of Product from Processor

For beef and pork the buyer shall be responsible for all arrangements to pick up the final product at the processor unless otherwise specified on product listing.

For chicken the buyer shall be responsible for all arrangements to pick up the final product at the processor during the pickup window given. Final product will be fresh and not frozen. Pickup must be made on the date and within the few hour window provided.

Risk of Loss

Buyer assumes risk of loss for the animal once delivered to and accepted by Processor.

Post Purchase

Buyer assumes all risks and liabilities upon purchase of the animal.  In any event, Seller is not responsible for actions of Buyer post purchase and Buyer agrees to indemnify Seller for any damages (including attorneys fees) incurred due to actions of Buyer.
