By placing an order, making a reservation, paying a deposit, or completing a purchase through our website, you agree to these terms. These terms govern all purchases of farm products, including but not limited to beef, pork, and chicken.
Deposit Requirement – A deposit is required to reserve any pre-order pre-order beef, pork, or poultry purchase. When an order is placed, the requested inventory will be held for up to 14 days while awaiting the required deposit. If the deposit is not received within 14 days, the reservation will be canceled and the requested product, share, or quantity will be returned to available inventory and may be sold to another buyer.
Deposits are applied toward the final purchase price and are non-refundable unless Living Springs Farm is unable to provide the product as agreed or approves otherwise.
For pre-order chickens, a $10 per bird deposit is required. Chicken pre-orders are available in increments of 12 birds. Once the deposit is received, the quantity ordered is considered final and cannot be reduced or changed.
Final Payment – The final balance for beef and pork will be based on hanging weight. The final balance for whole chickens will be based on the total number of birds ordered.
For beef, payment is due within 5 days after the buyer is notified of the final balance. For pork, payment is due within 2 days after the buyer is notified of the final balance.
For pre-order whole chickens, the remaining balance is due at the scheduled pickup. Pre-order chickens must be picked up during the designated pickup date and time provided by Living Springs Farm.
Whole chickens that have already been processed and frozen and are being sold from available inventory do not require a deposit unless otherwise stated and may be paid for at pickup.
Any unpaid balance after the applicable due date, failure to pick up a pre-order as scheduled, or abandonment of an order may result in loss of the deposit, release or resale of the product by Living Springs Farm, and forfeiture of the ability to purchase from us in the future.
Processing Fees – Processing fees are not included in the product price unless otherwise specified in the product description. Buyers are responsible for paying all processing fees directly to the processor.
We do not use glyphosate, herbicide, chemical fertilizers, or human waste fertilizers on our pastures or hay fields.
We do not use antibiotics, added hormones, steroids, or vaccines as part of our standard management practices. If an animal becomes ill or injured, medically necessary treatment may be provided when required for the animal’s health and welfare.
If an animal intended to fulfill the Buyer’s order receives treatment, or if our management practices change in a way that causes the animal or product to no longer meet the standards under which the order was placed, Living Springs Farm will notify the Buyer. If we are unable to fulfill the order with an animal or product meeting the original standards, the Buyer may choose to proceed with the treated animal or product. If the Buyer chooses not to proceed, the order will be canceled and all deposits and payments made toward that order will be refunded in full.
Any live weight, hanging weight, packaged weight, or product quantity provided before processing is an estimate unless expressly stated otherwise. Actual weights and yields may vary from animal to animal. Final charges based on hanging weight will be calculated using the actual hanging weight reported by the processor.
Processing dates, pickup dates, estimated weights, and product availability are estimates and are subject to change due to livestock conditions, processor scheduling, weather, equipment issues, or other circumstances beyond the reasonable control of Living Springs Farm. Living Springs Farm will make reasonable efforts to notify Buyers of any significant changes.
For beef and pork, the Buyer is responsible for making all arrangements to pick up the final product from the processor unless otherwise specified in the product listing.
For pre-order poultry, the Buyer is responsible for picking up the final product during the scheduled pickup window provided by Living Springs Farm. Pre-order poultry is intended to be picked up fresh and unfrozen. Pickup must be made on the designated date and within the specified pickup window. Because Living Springs Farm has limited refrigerated and frozen storage capacity, pre-order poultry cannot be held for later pickup unless prior arrangements have been approved.
Failure to pick up a pre-order during the scheduled pickup window may result in the order being considered abandoned. Failure to pick up a pre-order during the scheduled pickup window may result in the order being considered abandoned. In that event, the deposit will be forfeited, and Living Springs Farm may freeze, resell, or otherwise dispose of the product at its discretion.
Whole chickens that have already been processed and frozen and are being sold from available inventory may be picked up from Living Springs Farm at an agreed-upon pickup time. Availability of frozen poultry is subject to current inventory.
For beef and pork processed by a third-party processor, the Buyer assumes risk of loss once the animal has been delivered to and accepted by the processor. For poultry and other products picked up directly from Living Springs Farm, the Buyer assumes risk of loss upon taking possession of the product.
